Final Orleans County Municipality Passes Resolution

On Monday September 9th, the Lyndonville Village Board became the 14th Orleans County municipality to pass a resolution against the ‘un’SAFE Act. The resolution passed unanimously.

This makes Orleans County the 1st county in New York State to have all municipalities voice their opposition to the SAFE Act by passing a resolution.

This is a great achievement and it is hoped that other counties will soon be able to share the same distinction.

Village of Medina Passes Resolution

On Monday September 9th, the Medina Village Board unanimously passed a resolution against the NY SAFE Act. It is the 13th Orleans County municipality to pass a resolution.

Village of Albion Passes Resolution

The Village of Albion is the latest Orleans County municipality to pass a resolution against the SAFE Act. The resolution was adopted by the village on July 24th, 2013.

As of August 7th, there are only three municipalities left within Orleans County that have not yet passed a resolution against the SAFE Act..

RESOLUTION 2013-7 OF THE VILLAGE OF ALBION OPPOSING THE PROCESS OF ENACTMENT AND REQUESTING REPEALING OF THE NEW YORK SECURE AMMUNITION AND FIREARMS ENFORCEMENT (SAFE) ACT

WHEREAS, the right of the people to keep and bear arms is guaranteed as an individual right under the Second Amendment to the United States Constitution; and,

WHEREAS, the right of the people to keep and bear arms for defense of life, liberty, and property is regarded as an inalienable right by the people of Village of Albion; and,

WHEREAS, the lawful ownership of firearms is, and has been, a valued tradition in Albion, and the rights protected by the Second Amendment to the United States Constitution are exercised by many of our residents; and,

WHEREAS, the people of the Village of Albion and the State of New York derive economic and environmental benefits from all safe forms of recreation involving firearms, including, but not limited to, hunting and target shooting while utilizing all types of firearms available under the Constitution of the United States; and,

WHEREAS, the enactment of the NY SAFE Act (Chapter 1 of Laws of 2013) has prompted significant debate over both the process by which it was enacted and certain provisions contained within it; and,

WHEREAS, having reviewed the legislation and severely restrictive time constraints under which it was passed, it is our conclusion that there is no possible way any individual could read the entire bill and understand its full implications prior to voting on it; and,

WHEREAS, our state legislators most certainly did not have the time to request, and receive, the input of their constituents regarding this matter; and,

WHEREAS, there will be a significant financial impact due to the permits that will have to be renewed requiring additional manpower and computer systems their associated expense; and,

WHEREAS, Governor Cuomo has proposed spending $36 million dollars in his 2013-2014 Executive Budget for the implementation of the NY SAFE Act at a time when New York State residents are crying out for tax relief; and,

WHEREAS, this legislation severely impacts the possession and use of firearms now employed for defense of life, liberty, and property; and,

WHEREAS, this legislation severely impacts the possession and use of firearms now employed for forms of recreation including, but not limited to, hunting and target shooting; and,

WHEREAS, we find the legislation does little more than negatively impact lawful gun ownership.

NOW, BE IT RESOLVED, that, the Village of Albion does hereby oppose, and request the repeal of any legislation, including the sections within the NY SAFE Act (Chapter 1 of the Laws of 2013), which infringe upon the right of the people to keep and bear arms;

BE IT FURTHER RESOLVED, that the Village of Albion requests the members of New York State Senate and Assembly who represent all, or part of, Orleans County to reply, in writing, with their views on, and actions taken, in support of, or opposition to, the NY SAFE Act;

BE IT FURTHER RESOLVED, that a copy of this resolution be sent to President Barack Obama, Vice President Joseph Biden, Governor Andrew Cuomo, Senator Charles Schumer, Senator Kirsten Gillibrand, Congressman Chris Collins, New York State Senator George Maziarz, Assembly Speaker Sheldon Silver, New York State Assembly member Steve Hawley, and all other individuals and/or entities deemed necessary and proper.

Batavia City Council Passes Resolution Calling for the Repeal of the SAFE Act of 2013

On June 10th, the Batavia City Council passed a Resolution Calling for the Repeal of the SAFE Act of 2013 by a vote of 7 to 2.

The two council members that voted against the resolution stated that they felt that there were parts of the legislation that they agreed with and, therefore, could not support a repeal.

One councilwoman, Rose Mary Christian, said that she had been on the fence until the Boston Massacre. She noted that the Boston terrorists committed their horrific act with bombs and that legislation like this would not have prevented it. She also commented that council members did swear an oath to uphold the Constitution.

Orleans County Legislature Wants Full Repeal

The Orleans County Legislature revisited the issue of the NY SAFE Act at their April 24th meeting. They unanimously passed a resolution calling for repeal of the NY SAFE Act. Their original resolution, on February 13th, only opposed certain provisions.

According to the article, ‘Allport thanked the residents of the county who showed up at the county building about two weeks ago for a rally in opposition to the SAFE Act. He also said to his fellow legislators that they should oppose the entire act, and not just parts of it.’

Orleans County Calls for Repeal of the SAFE Act

The Orleans County Legislature unanimously passed it’s second resolution against the SAFE Act at it’s meeting on April 24th. The board originally passed a resolution on February 13th against certain provisions of the SAFE Act. This resolution, “calls for reconsideration and repeal of the so called NY SAFE Act of 2013.”

RESOLUTION NO. 173-413

ORLEANS COUNTY LEGISLATURE CALLS FOR REPEAL OF THE “NEW YORK SAFE ACT”

WHEREAS, the New York State Legislature enacted and Governor Andrew Cuomo signed into law the New York Secure Ammunition and Firearms Enforcement Act of 2013 (NY SAFE ACT); and

WHEREAS, this legislation is viewed by many citizens of the State of New York as being extremely controversial as those citizens view this Legislation as infringing upon their rights guaranteed to them under the second Amendment of the United State Constitution; and

WHEREAS, each and every issue that comes before the New York State Legislature before an enactment deserves a fair and open discussion which incorporates all points of views in order to ensure that all citizens are heard and that the Legislation incorporates the various points of view expressed during that discussion and benefits all of the citizens of the State of New York; and

WHEREAS, the NY SAFE ACT was adopted after minimal public discussion, contains serious flaws, i.e., police officers are not exempt, and having been on the desks of the members of the New York State Legislature for only a few hours, thereafter was literally adopted in the night and signed into law by Governor Andrew Cuomo; and

WHEREAS, the Governor has pledged to inflict no new unfunded mandates on local governments yet the Act contains no provision for funding the additional duties being imposed upon local Mental Health Departments, County Clerks, or local law enforcement agencies and as such constitutes yet another unfunded mandate by the State upon local municipal government with no corresponding revenue; and

WHEREAS, the Orleans County Legislature, by passage of Resolution No. 82-213, opposed the process of enactment and certain provisions contained within the New York Safe Act; and

WHEREAS, it is believed that many Orleans County residents are deeply concerned with this legislation, its effects, and the undue haste with which it was enacted; be it

RESOLVED, that the Orleans County Legislature calls for reconsideration and repeal of the so called NY SAFE ACT of 2013; and be it

FURTHER RESOLVED, that copies be sent to New York State Governor Andrew Cuomo, Senator George Maziarz, Assembly members Steve Hawley and Jane Corwin, NYSAC, Orleans County Towns and Villages, and all others deemed necessary and appropriate.

Resolution Passed in Town of Hartland

The Hartland Town Board unanimously passed a resolution against the SAFE Act on February 14th, 2013. Repeal of SAFE Gun Law
RESOLUTION 51-2013
WHEREAS,  the right of the People to Keep and Bear Arms is guaranteed as an Individual Right under the Second Amendment to the United States Constitution and under the Constitution of the State of New York, and
WHEREAS,  the Right of the People to Keep and Bear Arms for defense of Life, liberty, and Property is regarded as an inalienable right by the People of the Town of Hartland, Niagara County, New York, and
WHEREAS, the Hartland Town Board, being elected to represent the People of Hartland and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York and,
WHEREAS, legislation passed by the New York State Assembly and Senate infringes on the Right to Keep and Bear Arms and would ban the possession and use of firearms now employed by individual citizens of the Town of Hartland, for defense of Life, Liberty and Property and would ban the possession and use of firearms now employed for safe forms of firearms recreation, hunting, and shooting conducted within the Town of Hartland, Niagara County, New York.
WHEREAS, the Hartland Town Board believes there are many other less intrusive means available, other than rash, confusing and inarticulately drafted firearms laws that would effectively control, manage, and reduce violence in our society, such as, mental health reforms, anti-bullying programs for schools, enforcement of existing firearms laws to the fullest extent possible, and proper psychological counseling for those in need or who request it.
NOW, THEREFORE, BE IT HEREBY RESOLVED that the Hartland Town Board does hereby oppose the enactment of any legislation that would infringe upon the Right of the People to keep and bear arms and consider such laws to be unnecessary and beyond lawful legislative authority granted to our State representative, as there is no documented correlation between gun control measures and crime reduction.

On February 25th, the Lewiston Town Board unanimously passed a resolution in opposition to the NY SAFE Act. Board member Earnest C. Palmer asked, “How sad is it when a Town Board has to pass a resolution to support our Constitution?”

WHEREAS, the right of the people to keep and bear arms for defense of life, liberty and property is regarded as an inalienable right by the people of the Town of Lewiston, Lewiston, New York and

WHEREAS, the people of the Town of Lewiston, Lewiston, New York, derive economic benefit from all safe forms of firearms recreation, hunting, and shooting conducted within Lewiston using all types of firearms allowable under the United States Constitution and the Constitution of the State of New York and

WHEREAS, the Town of Lewiston Town Board being elected to represent the people of Lewiston and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York and

WHEREAS, the New York State Assembly and the New York State Senate being elected by the people of the State of New York and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of New York and

Marra complemented the growing number of Counties that have passed similar resolutions. This was rushed through with no public comments allowed. There is usually a three-day debate between the Senate and the Assembly. The Assembly was given 50-minutes to look at and pass. When it involves the Bill of Rights it should have been put out for discussion. It certainly does nothing it claims to do. It has been said that this law would have had no effect on the tragedy in Newtown, Connecticut or Aurora, Colorado. These are mental health reform and those items are necessary.

The Entire Town Board introduced Res. No. 56-2013 and moved its adoption, all Ayes:

RESOLUTION TO OPPOSE AND CALL FOR THE REPEAL OF THE NYS SAFE ACT

WHEREAS, the right of the people to keep and bear arms is guaranteed as an individual right under the second amendment of the United States Constitution and that this right is regarded as an inalienable right of the people of the Town of Horicon; and

WHEREAS, the lawful ownership of firearms is, and has been, a valued tradition in the Town of Horicon, and the rights protected by the Second Amendment to the United States Constitution are exercised by many of our residents; and

WHEREAS, the people of the Town of Horicon derive economic and environmental benefits from all safe forms of recreation involving firearms, including, but not limited to, hunting and target shooting while utilizing all types of firearms available under the Constitution of the United states; and

WHEREAS, the NY SAFE ACT was adopted by the New York State Legislature and signed into law in an unprecedented expedited fashion and completely devoid of any opportunity for our elected State Legislators to study, review and debate the legislation and without any opportunity for the public to comment upon the legislation or to have any input whatsoever upon the legislation; and

WHEREAS, requiring law-abiding gun owners to verify ownership of certain types of firearms every 5 years, in addition to registering them on their permits, which now also must be renewed every 5 years, does not increase the safety of the public and is unnecessarily burdensome to the residents New York State; and

WHEREAS, the only persons who will comply with the new high-capacity magazine ban are law-abiding citizens, leaving the same high-capacity magazines in the hands of those who choose not to obey the law; and

WHEREAS, requiring documentation of all ammunition sales in New York State, as provided for in this legislation is a significant unfunded mandate on businesses; and

WHEREAS, the legislation fails to offer any meaningful solutions to gun violence and places burdens squarely on the backs of law-abiding citizens; and

WHEREAS, while there are some areas of the legislation that the Town Board of the Town of Horicon finds encouraging, such as addressing the glaring shortcomings in the mental health system, the strengthening of Kendra’s law and Mark’s law, as well as privacy protections for certain pistol permit holders, by-and-large, we find the legislation does little more than negatively impact lawful gun ownership;

NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Horicon does hereby oppose, and request the repeal of, any legislation, including the sections of the NY SAFE ACT (Chapter 1 of the Laws of 2013) which infringe upon the right of people to keep and bear arms; and

BE IT FURTHER RESOLVED, that the Town Board of the Town of Horicon strongly encourages the members of the New York State Legislature to hold public hearings to address the issue of gun violence in a way that will produce meaningful results; and be it further

Resolved, that the Clerk of the Town Board of the Town of Horicon be, and hereby is, authorized and directed to forward copies of this resolution to the Governor Andrew Cuomo; Senator Charles E. Town of Moriah Passes Resolution Requesting Repeal of SAFE Act

WHEREAS, the legislation effectively turns countless New York State law abiding citizens into criminals; and

WHEREAS, while there are some areas of the legislation that the Town of Moriah Town Board finds encouraging, such as addressing glaring shortcomings in the mental health system, the strengthening of Kendra’s Law and Mark’s Law (which provides additional penalties for assaulting first responders), as well as privacy protection for pistol permit holders, by and large, we find the legislation does little more than negatively impact lawful gun ownership;

NOW THERE, BE IT RESOLVED, that the Town of Moriah Town Board does hereby demand the repeal of all the sections of the New York SAFE Act which we believe infringes upon the right of the people to keep and bear arms; and in our opinion unconstitutional under both the Federal and State Constitutions; and

BE IT FURTHER RESOLVED, that the Town Board strongly encourages the members of the New York State Legislature to hold public hearings to address the issue of gun violence in a way that will produce meaningful results; and be it further

RESOLVED that the Town of Moriah Town Board request the members of the New York State Senate and Assembly who represent all of the Town of Moriah for the repeal of the enactment of the New York SAFE Act.

Discussion: The Board of Supervisors have been beat up over this bill; everyone feels differently about this. We want the State to repeal the bill and start over, but doubts that will happen.
